Contract for Ferry Services between Malta and Comino is valid and effective

“The contract is valid and effective” – The Public Contracts Review Board about the contract for Ferry Services between Malta and Comino

“The ferry services between Malta and Comino contract is valid and effective”.

The Public Contracts Review Board stated this in its answer for an appeal filed against this contract back in January. The board did not uphold the appellant’s contention.

The board confirmed that a prior notice was published in the Official Journal of the European Union on 29th May 2019, against what the appellants had declared. The board also affirmed that Transport Malta applied the proper Common Procurement Value (CPV) code and also used the proper form, which is automatically generated.

The board was surprised that the appellants claimed that they were prejudiced because they were not aware of the publication of the RFP, when in fact, the appellants had asked for clarifications during the process.

The Public Contracts Review Board concluded and confirmed that the procedure carried out by Transport Malta was in total conformity with the provisions of local and European Union legislation.
