Registration of End-Of-Series Vehicles

What is an End-Of-Series vehicle?

End-of-series vehicles are vehicles that are in stock and have not yet been registered for use when new requirements for vehicles enter into force.

When legislative standards change and new legislation is coming into force, the EU may permit Member States to allow manufacturers to place on the market, offer for sale, register and/or enter into service certain vehicles that do not comply with the incoming standards.

For vehicles that do not meet the new requirements, a derogation exists whereby end-of-series vehicles can be sold and registered for use in Malta if they have EC type approval. The derogation relating to end-of-series vehicles sets limitations in terms of both time and the number of vehicles.

What is the qualifying criteria for an End-Of-Series derogation?

Passenger and goods vehicles (N1, N2, N3, M1, M2, M3 categories). The date of manufacture on the CoC must be at least 3 months before the new regulation comes into force.
Motorcycles, mopeds, trikes and quads (L category). The date of manufacture on the COC can be any day before the new regulation comes into force.
Tractors (T Category). The date of manufacture on the COC can be any day before the new regulation comes into force.

Is there a limit on the number of End-Of-Series vehicles that may be registered?

Passenger vehicles (M1 category). 10% of vehicles registered in Malta during the previous year or 100 vehicles, whichever is the higher.
Passenger and goods vehicles (N1, N2, N3, M2, M3 categories). 30% of vehicles registered in Malta during the previous year or 100 vehicles, whichever is the higher.
Motorcycles, mopeds, trikes and quads (L category). 10% of the number of vehicles registered in Malta in the two preceding years or 100 vehicles, whichever is higher.
Tractors (T Category). 10% of the number of vehicles registered in Malta in the two preceding years or 20 vehicles, whichever is higher.

How long does a derogation last?

Note: The additional time provided by the derogation e.g. 12 or 18 months begins on the date changes were brought into law or the date the vehicle lost its type-approval validity - NOT the date of the derogation application.

What is the difference between a complete, completed and incomplete vehicle?

Complete vehicles. Built in a single stage by the manufacturer and requires no further work
Completed vehicles. Built in multi stages involving more than one manufacturer.
Incomplete vehicles. Any vehicle which has yet to undergo one or more stages.

How can I apply for an End-of-Series derogation?

To apply for End of Series derogation, please complete the relevant Form and Vehicle Details List and email them to vehiclesverification.tm@transport.gov.mt.
