Regulation (EC) No 1008/2008 on common rules for the operation of air services in the community defines air service as a 'flight or a series of flights carrying passengers, cargo and/or mail for renumeration and/or hire'.
This regulation also contains definitions of Operating License and Air Operator Certificate.
Operating Licenses are issued by the Civil Aviation Directorate. Every AOC holder requires to obtain an Operating License in accordance with Regulation (EC) No 1008/2008.

Air Operator Certificate (AOC)
Air Operator Certificate means a certificate deliverd to an undertaking confiorming that the operator has the professional ability and the organisation to ensure the saftey of operations specified in the certificate, as provided in the relevant provisions of Community or national law; as applicable.
AOC approvals are issued in accordance with commission regulation (EC) No 859/2008, ANNEX III, referred to as EU OPS.

Air Service Agreements
Scheduled services operate on the basis of bilateral agreements between Malta and another State. These set out the operating rights, terms and conditions that have to be followed by the carriers designated by each State. In the absence of such an air service agreement, commercial air services may be operated on a temporary basis at the discretion of the respective aeronautical authorities.
